Reseller Acceptable Use Policy

In addition to the general Acceptable Use Policy, resellers must also comply with the following guidelines.

Content

All reseller sites on Hosting Matters, Inc.’s servers must abide by the content guidelines as established in the general Acceptable Use Policy. Resellers are responsible for ensuring that their clients’ sites fall within those guidelines. Sites found to be violating content guidelines will result in a notice being sent to the reseller for action. Should the reseller fail to take appropriate action, a warning will be issued to the reseller, and the offending site’s owner will be notified directly by the Hosting Matters, Inc. Abuse Investigation department. Repeated warnings will result in the termination of the reseller’s contract with Hosting Matters, Inc. Repeated violation by a site owner who is a client of the reseller will result in the suspension or deactivation of the client site.

Reseller accounts are for the sole purpose of reselling space allocated by Hosting Matters, Inc. Accounts found to be violating this policy will be suspended immediately until such time as the reseller corrects the issues raised. Repeated suspensions will result in a request to the reseller to select another hosting company. A notice period of thirty (30) days will be given should such a request be made.

Resellers are required to post their Acceptable Use Policy on their site in a manner that is easily accessible to potential and current clients. Hosting Matters, Inc. will periodically review resellers’ sites to ensure this policy is maintained.

Commercial Advertising – Email

Spamming, or the sending of unsolicited email, from a Hosting Matters, Inc. server or using an email address or domain that is maintained on an Hosting Matters, Inc. server as reference is STRICTLY prohibited. Resellers are responsible for investigating complaints of abuse by their clients. Complaints received by Hosting Matters, Inc. will be forwarded to the reseller for action if the client in question has been determined to be a client of the reseller. Failure by the reseller to take appropriate action on such complaints will result in a warning for the reseller, and in a direct warning to the client from Hosting Matters, Inc. Repeated warnings will result in suspension of the client site without notice, and may result in warnings and/or suspension for the reseller if the abuse complaints are found to be valid.

Misuse of System Resources

System resources will be monitored by Hosting Matters, Inc. Resellers are responsible for contacting their client(s) if said client(s) is/are found to be utilizing excess system resources. The operation of IRC servers or bots is prohibited, as is the resale or remote operation of CGI scripts from Hosting Matters, Inc. servers. Additional bandwidth is charged at $3/G.

Cancellation

Cancellation requests must be made via email to billing@hostmatters.com or via the online ticketing system at https://secure.hostmatters.com. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include fees for domain registration. Although no notice is required, to safeguard resold accounts, resellers wishing to cancel their accounts must take appropriate measures for their resold accounts prior to cancellation. If for any reason a reseller account is cancelled or terminated without proper attention or care for resold accounts being taken, Hosting Matters, Inc. will directly contact clients of the reseller to make appropriate arrangements for said accounts.

Suspension

Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses that are found to be valid after investigation will be grounds for suspension.

Refusal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion. Please direct any reports of violations of the above policies to abuse@hostmatters.com. Failure to follow any term or condition will be grounds for immediate account deactivation.
